FOR INDIVIDUAL CLIENTS

Application form completion service

We can assist in completing an application form for the folliwng benefits:

  • Personal Indepdence Payment
  • Universal Credit (LCW/LCWRA UC50)
  • Employment and Support Allowance (ESA50)
  • Disability Living Allowance
  • Attendance Allowance
  • Carer’s Allowance

The fee charged for an appointment to complete an application form is set at £175.00, which is payble in advance.

The appointment can last up to 2 hours. An additional fee will be charged if the appointment exceeds its 2 hour slot.

The fee is non-tangible and irrevocable, and is not contingent on a successful benefit application.

Full casework appeal package, fixed fee “no win no fee”

Including case management and Tribunal correspondence, the full case work appeal package covers up to 35 hours labour dedicated per appeal. This package provides individual clients with the following services as appropriate:

  • consultations on the merits of the appeal
  • pre-appeal stages and mandatory reconsideration
  • evidence evaluation and preparation
  • preparation of your court bundle (appeal submission, statement of the facts, evidence schedule)
  • arrangements for key witnesses where necessary
  • representation at appeal hearings (hearing options by telephone, cloud video platform, or traditional face to face)

At the Tribune Legal Practice we understand that a client that has been denied the benefits they are rightly entitled to, will not always have the disposable income to cover their appeal representation costs up front.

Therefore for individual clients we offer our full case work appeal package on a fixed fee and not an hourly rate, charged on a “no win no fee” basis.

  • The fee is only payable if your appeal is won (decided at any stage of the reconsideration or appeal process, whether by a Judge or decision maker of the respondent authority)
  • The fee is calculated as 40% of the value of your appeal
  • The value of your appeal is worked out by calculating the benefit entitlement owed to you, from the date of the decision that you are appealing to the date that the appeal is won
  • This period can be 9 to 12 months, or more, and your appeal will usually have a monetary value in between £4000 to £6000, depending on which benefit, or combination of benefits, you are appealing. Should litigation continue to the Upper Tribunal, the monetary value of your appeal will increase further

Please note: an additional fee will be added to the initial fixed fee should the labour required in your appeal exceed 35 hours. At all times you will be updated as to the ongoing costs of the appeal should they be above the fixed fee. Any additional fee will be charged on a “no win no fee” basis.

Furthermore our fee does not in any way constitute a payment of benefit, it is a fixed fee calculated with reference to the monetary value of an appeal. Our services are non-tangible and irrevocable, meaning that the fee is non-refundable following the successful completion of an instruction, including in the event of a future change of circumstances affecting any benefit entitlement.

Complex appeal package, fixed fee or hourly rates

A standard fixed fee or hourly rate will apply for appeals that require in excess of 35 hours labour, or that are legally complex – such as right to reside, overpayments and their recovery, or appeals with concurrent benefit fraud prosecutions. The fee is negotiated on a case by case basis and will depend on the nature of the appeal. For further information please get in touch. 

Travel Costs

No additional fees will be charged for costs incurred in the delivery of a “no win no fee”, fixed fee package to individual clients.

Travel costs will be charged in the delivery of services for corporate/third sector clients. 

Disbursements

The appellant is liable for third party costs such as those incurred for obtaining extra evidence from medical practitioners, consultants or other expert witnesses. Third party fees are payable in addition to our fees. 

FOR CORPORATE/THIRD SECTOR CLIENTS

The Tribune Legal Practice can provide legal services for corporate clients/third sector organisations at an hourly rate worked out depending on the monetary value of the appeal (arrears and future award). The monetary value of the appeal is usually linked to its nature and complexity, categorised as simple, standard or complex.

In the initial consultation we shall endeavour to given an estimate amount of hours required to resolve the appeal, and where possible we will advise if more labour will be required. For more complex appeals, you will be continually updated as to the on-going costs of the appeal.

Travel Costs

Travel costs incurred with the provisions of services will be added to the final invoice.

Disbursements

The appellant is liable for third party costs such as those incurred for obtaining extra evidence from medical practitioners, consultants or other expert witnesses. Third party fees are payable in addition to our fees. 

UPPER TRIBUNAL APPEALS

A standard fixed fee or hourly rate will apply for appeals commenced directly at the Upper Tribunal on a point of law. The fee is negotiated on a case by case basis and will depend on the nature of the appeal. For further information please get in touch. 

ADDITIONAL SERVICES

Rent Repayment Orders – representation and litigation advice for bringing or defending claims.

Benefit fraud investigations – overpayment calculations, witness reports, witness attendance at Magistrates or Crown Court, and appeals at the First Tier Tribunal pending prosecution.
