EXPERTISE GAINED AT THE APPEAL TRIBUNAL

We use our knowledge gained at the appeal Tribunal to assist you in completing an application form for the above listed benefits, so that it is written based according to the relevant laws, regulations, and caselaw. We are also able to advise what evidence you need to provide to strengthen your application, and how to prepare for any subsequent medical assessments.

MEDICAL CONDITIONS DO NOT DETERMINE ENTITLEMENT

It is a common misconception that entitlement to incapacity and disability benefits is based on a medical condition or diagnosis. Although this is relevant, what determines entitlement is the application of the relevant laws to the specific facts of your circumstances, which seeks to determine your levels of functionality. An incorrectly completed application form will damage your chances of obtaining the benefit you are claiming, and will further undermine any subsequent appeal, making it harder to discharge your evidential burden of proof that do qualify for the benefit you are claiming.

A properly completed application under the guidance of a trained representative that has knowledge of social security law, will strengthen your application at first instance and increase your chances of having the correct level of entitltlement awarded. In the event of your claim being unsuccessful at first instance, a properly completed application form will be an important item of evidence for any subsequent appeal.
